COMING SOON: Scotland and the Court of Justice of the European Union: An Enduring Legacy?

This edited volume offers a unique reflection on the European Union and its judiciary – the Court of Justice of the EU – through a distinctly Scottish lens. Bringing together an assembly of seasoned scholars and practitioners, including former CJEU judges, the book probes the extent to which a particular Scottish influence and legacy might be identified, looking back at almost 50 years of presence through the United Kingdom’s EU membership. The collection inter alia provides substantive reflections on cases originating from Scotland landing on the Court’s docket, the influence exerted via Scots law trained judges, as well as gender (im)balance at the CJEU and Scotland’s supreme court in civil matters (the Court of Session). More generally, the included studies testify to a significant cross-fertilisation, demonstrating how EU membership left a profound influence on Scots law and legal culture. The combination of personal, memoir-style reflections from ‘insiders’ such as Judge Edwards and Judge Forrester, with more traditional academic analyses from scholarly ‘outsiders’, ultimately reveals a fascinating and clearer picture of the myriad ways in which Scots lawyers and the Scots legal system engaged with, and richly contributed to, the evolution of European Union law.
